Terms of Use

Welcome to the ENJOYGM mobile application (the "Application") (collectively, the "Platform" or "APP"). ENJOYGM is an online digital goods and services platform that facilitates the sale and purchase of games, related merchandise, and such other items (including, but not limited to, game cards, gift cards, live streaming products, and game top-ups) between game publishers or merchants and buyers or customers.
These Terms of Use govern your rights and obligations as a user of the Platform managed and administered by JUST HAVE FUN GROUP LIMITED and its subsidiaries and affiliates (individually or collectively, "EGM" or "we," "us," or "our"). Unless otherwise specified by ENJOYGM, all new Platforms launched and administered by ENJOYGM shall be governed by these Terms of Use.
By registering an account with ENJOYGM and accessing any Platform, you acknowledge and accept that your use of the Platform (or any of them) is subject to these Terms of Use and any other specific rules, procedures, terms, and conditions specified on the corresponding Project page, which may be modified by ENJOYGM at any time and from time to time in its sole discretion. In the event of any inconsistency, the terms and conditions specified on the corresponding Project page will prevail. Your acceptance of these Terms of Use will constitute a legally binding agreement between ENJOYGM and you as the user.
We may amend, modify, or update these Terms of Use from time to time. Any future changes we make to these Terms of Use will be posted and published on the Platform and, where appropriate, notified to you by email, so your continued access to the Platform and/or use of any Services constitutes your acknowledgment, acceptance, and agreement to the changes we make to these Terms of Use. Please check back frequently for any updates or changes to these Terms of Use.
1. Definitions
In these Terms of Use, unless the context otherwise requires, the following words and expressions shall have the following meanings:
1. Account: means the account you duly register with ENJOYGM to facilitate your use of the services (or any of them) offered on the Platform;
2. Buyer: means a person who purchases items on the Platform;
3. Content: means all information, linked page functionality, data, text, images, photos, graphics, music, sound, video, messages, tags, content, programs, software, tools, application services (including but not limited to any mobile application services), or other materials available on or through the Platform or its related services;
4. Intellectual Property: means all copyrights, trademarks, service marks, brand names, logos, copyrighted information, and other intellectual property rights belonging to the respective owners/publishers/developers and/or ENJOY GM;
5. Item: means any item, product, or service offered for sale on the Platform;
6. Legal Age: means the legal age required to give consent under the applicable laws of your jurisdiction. 7. Parties: collectively, ENJOYGM and you; "Party" means any of them;
8. Platform: collectively, the web platform currently known as the ENJOYGM Android app, the ENJOYGM iOS app, and other web and/or mobile platforms managed and administered by ENJOYGM;
9. ENJOY GM Points: electronic points that buyers can purchase from ENJOY GM for use in purchasing goods and services on the Platform;
10. Services: (a) the Platform; (b) the services provided by the Platform and the client software offered through the Platform, including (but not limited to) the sale/resale/retail/purchase of games, related goods and items, game advertising/distribution, and game point top-ups/top-ups/reloads; and (c) Content. 11. Submissions: means any materials, information, or ideas provided by you to ENJOYGM in any manner;
12. Terms of Use: means the Terms of Use governing your use of the Services, which ENJOYGM reserves the right to amend from time to time as ENJOYGM deems necessary in its absolute discretion, and shall include: (i) any rules, procedures, and terms of use for products, services, or facilities determined from time to time by ENJOYGM; (ii) any documents, instructions, correspondence, and agreements referred to in and forming part of these Terms of Use, and any amendments to any of the foregoing made at any time or from time to time; and
13. User ID: means the unique user identification provided to you during account registration.
2. License to Use
In consideration of your agreement to these Terms of Use and your continued compliance with and adherence to these Terms of Use, ENJOY GM hereby grants you a non-exclusive, non-transferable license to access the Platform and use the Services in accordance with the terms and conditions set forth herein.
3. Representations and Warranties
Each time you access this Platform (or any Platform), you irrevocably and unconditionally represent and warrant that you are of legal age. If you are under legal age, you must obtain permission from your parent or legal guardian to register for an account, and such parent or legal guardian must agree to and consent to these Terms of Use on your behalf:
1. Your personal information and documents submitted in connection therewith, including but not limited to your full name, telephone number, mailing address, and email address, are true and accurate. You will promptly notify us in writing of any changes to your personal information.
2. You will keep your account password secure and confidential. You shall not reveal or disclose your account password to any unauthorized party at any time and under any circumstances, and shall take all measures to prevent the disclosure of your account password to any unauthorized party; You shall not, and agree and undertake that ENJOYGM will not:
(1) use the Services to impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity;
(2) use the Services directly or indirectly for any commercial purpose, unless otherwise permitted by ENJOYGM;
(3) use the Platform or the Services (or any of them) to conduct any fraudulent, unethical or illegal activity or activity that may infringe the intellectual property rights of a third party or obtain any benefit, advantage or secret profit from any third party;
(4) use any intellectual property rights belonging to ENJOYGM or any other third party owner listed on the Platform, including but not limited to trademarks or trade names, whether registered or not, without ENJOYGM's prior written consent;
(5) take any action that may undermine or manipulate the feedback or rating system;
(6) be disruptive, offensive or harassing to other users of the Platform or ENJOYGM employees in any way;
(7) attempt to decompile, reverse engineer, disassemble or crack the Service (or any part thereof), or crack or overcome any encryption technology or security measures we implement on the Service and/or data transmitted, processed or stored by us;
(8) harvest or collect any information about other account holders, including, without limitation, any personal or business information;
(9) upload, email, post, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of unauthorized solicitation;
(10) upload, email, post, transmit or otherwise make available any material that contains software viruses, worms, Trojan horses, or any other computer code, routines, files, or programs designed, directly or indirectly, to interfere with, manipulate, interrupt, destroy, or limit the functionality of the Service. (1) interfere with, manipulate or disrupt the functionality or integrity of the Services or any computer software, hardware, data or telecommunications equipment;
(11) interfere with, manipulate or disrupt the Services or any servers or networks connected to the Services or any other use and enjoyment of the Services, or violate any requirements, procedures, policies or regulations of networks connected to the Platform;
(12) take or engage in any action that could, directly or indirectly, damage, disable, overburden or impair the Services or any servers or networks connected to the Services;
(13) use the Services to intentionally or unintentionally violate any applicable local, state, national or international laws, rules, regulations, codes, directives, guidelines or policies, including but not limited to laws and requirements (whether or not having the force of law) related to anti-fraud, anti-money laundering, anti-terrorism, illicit proceeds and anti-corruption;
(14) use the Services to violate or circumvent any sanctions or embargoes or laws enforcing the same;
(15) copy, attempt to copy or counterfeit ENJOYGM Points and/or Items; and
(16) directly or indirectly recruit and/or poach any customers obtained through the use of the Platform.
4. User ID
1. In order to access and enjoy the full functionality and features of the Platform and/or Services, you may be required to create and register an ENJOYGM account by providing certain personal information. You hereby acknowledge and agree that ENJOYGM may conduct a credit check on you, including but not limited to checks with registered credit bureaus or reporting agencies, to determine your creditworthiness, and you agree to sign all consent forms or provide other documents required for such credit checks if requested by ENJOYGM.
2. We will provide you with a user ID, and you will be able to set a password and/or security code for your account, subject to certain requirements subsequently notified. When registering with ENJOYGM, you agree to provide accurate, current, and complete information about yourself and to update such information if it changes. Failure to do so may result in the closure of your account and any web pages and/or other pages and/or reports created under your ENJOYGM account. If we rely on the content of your application and accept you to use our services, you irrevocably agree that you will indemnify and hold us harmless for any costs, losses or damages we may suffer as a result of any inaccuracies or false statements or misrepresentations of facts submitted by us to you. We have the right to suspend or terminate your account if, in our sole discretion, you determine that the User ID you choose is offensive or inappropriate.
5. Use of the Services
1. You shall purchase, at your own expense, the equipment and software necessary to connect to and access the Platform and subsequently use the Services. You shall be responsible for all fees and charges imposed by third parties in connection with your connection of your equipment to the Platform (or any of them).
2. Your primary responsibility is to ensure that you are familiar with the guidelines and procedures for using the Services that ENJOYGM may publish from time to time. ENJOYGM assumes no liability for any errors, losses, or damages arising from your use of the Services.
3. You are responsible for safeguarding the information in your account. Any notifications or confirmations received by ENJOYGM from your account shall be deemed to have been issued by you, notwithstanding that such notifications or confirmations may have been issued by a third party (whether authorized or unauthorized), and you shall be bound by such notifications or confirmations.
4. ENJOYGM is not responsible for taking action on notifications or confirmations sent through your account. ENJOYGM has no obligation to investigate the authenticity or authority of the person providing the notifications or confirmations, or to verify the completeness of such notifications or confirmations. Notwithstanding any error, fraud, forgery, ambiguity, or misunderstanding in the terms of such notification or confirmation, such notification or confirmation shall be deemed irrevocable and binding upon you upon receipt by ENJOYGM. You shall promptly notify ENJOYGM upon receiving incomplete, garbled, or inaccurate data or information from ENJOYGM. You shall also promptly notify ENJOYGM upon receiving any data or information that is inappropriate for you, and you shall delete such data or information from your account.
5. We may, at any time and from time to time, subcontract and/or designate our subsidiaries, affiliates, related entities, and/or any third-party service providers to operate the Platform and/or provide the Services and/or parts of the Content on our behalf, at our absolute discretion. We reserve the right to delegate, transfer, assign, or novate all or part of our rights, interests, or obligations to our subsidiaries, affiliates, related entities, or designated third-party service providers without your consent or notice.
6. Unless otherwise permitted in writing by ENJOYGM, you may not upload, post, email, transmit or otherwise make available any unauthorized or illegal activity on the Platform or directly to other users of the Platform.
7. You may not upload, post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment, including but not limited to the Platform.
8. You irrevocably and unconditionally permit and grant ENJOYGM permission to send updates to your account regarding services and events offered or provided by ENJOYGM.
9. Third-party links may be provided throughout the Platform. These links are provided solely as a courtesy and the websites they link to are not under our control in any way, so you access them at your own risk. We are not responsible for the content of any such linked websites or any link contained in a linked website, including any changes or updates to such websites. We provide these links merely as a convenience, and the inclusion of any link does not in any way imply or express our affiliation, endorsement, or sponsorship of any linked website and/or any content thereon.
10. You acknowledge that by accessing or using the Platform, you may be exposed to content that you may find offensive, indecent, or objectionable. To the maximum extent permitted by applicable law, under no circumstances will we be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of or reliance on any Content posted, emailed, transmitted or otherwise made available on the Platform.
6. Goods and Services
1. All items reflected in your account are granted to you on a limited, revocable license basis, and their use is subject to the terms that ENJOYGM may impose from time to time.
2. The value of items reflected in your account does not represent any real monetary credit value. These items cannot be redeemed for real cash.
3. Unless otherwise permitted in writing by ENJOYGM, you may not sell, transfer, or otherwise dispose of items to any other person, whether within or outside the Platform (or any Platform).
7. Availability of Services
1. We may release beta or trial versions of certain services or their features, which may not work properly or in the same manner as the final version, and we assume no liability in such cases.
2. ENJOYGM may, from time to time, require verification of your identity to confirm your ownership of your account. This verification process is necessary for purposes including, but not limited to:
(i) fulfilling ENJOYGM's obligations to relevant authorities regarding combating suspicious or illegal activities, money laundering, and the financing of terrorism;
(ii) enabling ENJOYGM to take action when unauthorized use of ENJOYGM accounts is detected; and
(iii) resolving any disputes regarding ownership of ENJOYGM accounts.
3. You hereby irrevocably authorize ENJOYGM (whether acting on its own or through its third-party service providers) to conduct any inquiries and collect any documents it deems necessary to verify your identity. As part of this verification process, ENJOYGM will request, and you will provide to ENJOYGM, true, accurate, current, and complete information about yourself that can be verified by documents that are legally recognized and accepted in the jurisdictions where such documents are issued.
4. We reserve the right to change, modify, suspend, or terminate all or any part of the Platform and/or Services at any time or upon notice as required by applicable law. We may also, at our sole discretion, impose limits on certain features or restrict your access to part or all of the Platform and/or Services without prior notice or liability to you.
5. ENJOYGM may, from time to time, conduct software evaluations to assess the performance level of the Platform and/or Services for enhancement and improvement purposes. You hereby irrevocably authorize ENJOYGM to conduct periodic reviews of your account, including, without limitation, evaluating your activity and/or transactions conducted on the Platform or through your account.
6. In addition to and without derogation from the following terms, ENJOYGM may, in its sole discretion, charge you an account maintenance fee if you do not use the Services for twelve (12) consecutive months.
8. Disclaimer, Exclusions, and Force Majeure
1. You agree and acknowledge that you shall not hold ENJOYGM, its employees, agents, or licensees liable for any special, incidental, or consequential damages arising out of or in connection with the Services or these Terms of Use.
2. Unless otherwise specified herein, the Services are generally available on a daily basis. While we strive to ensure the security of the Platform and/or Services, you acknowledge and agree that you bear the entire risk arising from accessing, using, or performing the Platform and/or Services, to the maximum extent permitted by applicable law.
3. The Platform and/or Services are provided on an "as is" and "as available" basis, and we make no warranties, claims, or representations, whether express, implied, or statutory, including, but not limited to, warranties of quality, performance, non-infringement, merchantability, or fitness for a particular purpose, and there are no warranties arising from course of dealing, course of performance, custom, or usage of trade. Without limiting the foregoing, to the maximum extent permitted by applicable law, we do not warrant that the Platform and/or Services, or the functions contained therein, will be available, accessible, uninterrupted, timely, secure, accurate, complete, or error-free, that defects (if any) will be corrected, or that the Platform and/or the server that makes the same available are free of viruses, clocks, timers, counters, worms, software locks, freezing devices, Trojan horses, routing holes, trap doors, time bombs, or any other harmful code, instructions, programs, or components.
4. To the maximum extent permitted by applicable law, in no event shall we be liable, whether in contract, warranty, tort (including, but not limited to, negligence (whether active, passive, or imputed), product liability, strict liability, or other theory), or any other cause of action at law, equity, statute, or otherwise:
1. (i) loss of use;
(ii) loss of profits;
(iii) loss of revenue;
(iv) loss of data;
(v) loss of goodwill;
(vi) failure to realize expected direct or indirect savings; and
2. Any direct or indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the use of or inability to use the Platform or the Services, including, but not limited to, any damages resulting therefrom, even if we have been advised of the possibility of such damages.
3. ENJOYGM shall not be liable for any delay or failure in performance of the Services, regardless of the cause of such delay or failure. Such causes may include, but are not limited to, acts of God, riots, civil commotion, strikes (whether or not involving ENJOYGM employees), lockouts or other labor disturbances, fire, war, acts of foreign enemies, power outages, epidemics, pandemics, network congestion, telecommunications failures, power failures, or any failure, interruption, disruption or malfunction of equipment, tools, utilities, communications, computer (software and hardware) services or networks, governmental orders, or changes in any laws or regulations that make performance impractical.
4. You acknowledge, accept, and agree that all disclaimers, exclusions, and limitations of liability set forth in these Terms of Use represent a fair and reasonable allocation of the risks and benefits of the agreement between ENJOYGM and you, taking into account all relevant factors, including limiting the value of the consideration provided by ENJOYGM to you. You further agree that these disclaimers, exclusions, and limitations shall be enforceable to the fullest extent permitted by applicable law.
9. Intellectual Property
1. We grant you a limited, revocable license to access and use the accompanying software we make available to you through the Platform as part of the Services. Use of such software is subject to these Terms of Use. Any third-party scripts or code linked to or referenced from the Services are licensed to you by the third party that owns such scripts or code. You may not, directly or indirectly, modify its features or functionality, copy or create derivative works using all or any part of it, analyze or remove components thereof, decompile or otherwise reverse engineer or attempt to reverse engineer or derive the source code, algorithms, or processes within the technical software, or permit or encourage any third party to do so.
2. All proprietary content and intellectual property displayed on the Platform are the exclusive property of ENJOYGM and, where applicable, third-party owners. No right or license is granted, directly or indirectly, to any party accessing the Platform to use or reproduce any intellectual property, and no party accessing the Platform may assert any right, title, or interest therein. By using or accessing the Services, you agree to comply with copyright, trademark, applicable intellectual property legislation, and all other applicable laws protecting the Services, the Platform, and its content. You agree not to copy, distribute, republish, transmit, publicly display, publicly perform, modify, adapt, rent, sell, or create derivative works of any part of the Services, Platform, or their content. You also may not mirror or frame any part or all of the Platform on any other server or as part of any other website, except with our prior written consent. Furthermore, you agree not to use any robot, spider, or any other automatic device or manual process to monitor or copy our content without our prior written consent (such consent is deemed given for standard search engine technology employed by internet search sites to direct internet users to the Site).
3. No Submission will be treated as confidential by ENJOYGM, and we may disseminate or use any Submission for any purpose, including, but not limited to, developing and marketing products, without compensation or liability to you. By submitting a Submission to ENJOYGM, you acknowledge and agree that we and/or other third parties may independently develop software, applications, interfaces, products, and modifications and enhancements thereof that are identical or similar in functionality, code, or other features to those of ENJOYGM, including the ideas presented in your Submission. Therefore, you hereby grant us and our successors a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to develop such products and to use, copy, distribute, republish, transmit, modify, adapt, create derivative works of, publicly display, and publicly perform any Submission on, through, or in connection with the Service in any media formats and through any media channels, including, but not limited to, promoting and redistributing portions of the Service (and derivative works thereof). This provision does not apply to personal information subject to our Privacy Policy unless you publicly make such personal information available on or through the Service.
10. Platform Reliability
1. You understand that all transactions conducted on the Platform are conducted over telecommunications and data networks.
2. You fully understand that your receipt of notifications from ENJOYGM (and vice versa) may be delayed or prevented by factors affecting the relevant service providers and other parties. You agree that ENJOYGM cannot guarantee the timely delivery of such notifications or confirmations.
3. You acknowledge and confirm that you will take all steps and measures to review and verify your account's transaction history.
11. Accounts
1. If you know or believe that your account has been hacked or compromised, you will immediately notify ENJOYGM.
2. You are responsible for all transactions conducted through your account until ENJOYGM receives your notification (as described in Section 14).
12. Information Disclosure
1. ENJOYGM reserves the right, and you irrevocably and unconditionally consent and authorize ENJOYGM to disclose or publish any information relating to you or your transactions through the Platform, to the extent permitted by law. ENJOYGM may, in its sole discretion, deem appropriate to:
(1) ENJOYGM may be required to disclose information under applicable law;
(2) to other individuals or entities pursuant to any government directive or court order;
(3) to enforce these Terms of Use;
(4) to respond to your customer service requests; or
(5) to any other party ENJOYGM deems appropriate.
2. Unless otherwise permitted by these Terms of Use, ENJOYGM will not disclose your personal information to any other party without prior notice to you.
13. Governing Law and Indemnification
1. These Terms of Use shall be governed by and construed in accordance with the laws of Hong Kong, China, without regard to its conflict of law principles. Any dispute, legal action, or proceeding arising out of or relating to these Terms of Use shall be subject to the jurisdiction of the courts of Hong Kong, China, unless ENJOYGM, in its sole discretion, elects to resolve such issue through arbitration in Hong Kong, China or other means.
2. Where necessary, you shall obtain approval, consent, or permission from the relevant regulatory authorities before using the Services.
3. For cross-border transactions, you shall not violate the laws in force in the countries involved in the transactions.
4. You agree to indemnify, defend, and hold harmless us and our shareholders, subsidiaries, affiliates, related entities, directors, officers, agents, representatives, co-branders, and employees (collectively, the "Indemnified Parties") from any and all damages. indemnify any Indemnified Party from and against all claims, actions, proceedings and suits and all related liabilities, damages, settlements, penalties, fines, costs and expenses (including, but not limited to, legal fees and dispute resolution expenses) arising out of or relating to:
(i) your breach or violation of any of these Terms of Use or any policies or guidelines referenced herein;
(ii) your use or misuse of the Platform or Services, or
(iii) your violation of any law or any rights of a third party.
14. Suspension, Termination, and Cancellation of the Service
1. ENJOYGM may cancel the Service (or any part thereof) at any time without notice. Following cancellation, the Service (or any part thereof) may be reinstated in the manner and subject to the Terms of Use determined by ENJOYGM in its sole discretion.
2. You may deactivate your account at any time by notifying us of your intent, subject to the deactivation fee (if any) charged by us.
3. ENJOYGM reserves the right to suspend or block access to and use of the Service (or any part thereof) at any time, for any reason, for any period of time, and under any conditions determined by ENJOYGM in its sole discretion. Grounds for suspension or termination may include, but are not limited to:
(1) the account has been inactive for 36 consecutive months or any other period determined by ENJOYGM;
(2) having multiple user accounts or allowing unauthorized persons to access and use the account;
(3) we believe that your account behavior or use of the Platform and/or Services is dishonest, fraudulent, illegal, criminal or misrepresentative;
(4) you have breached, or we have reasonable grounds to believe that you have breached any of these Terms of Use and/or any applicable terms and conditions provided by ENJOYGM from time to time, or have done anything that is detrimental to ENJOYGM or we believe that your behavior is detrimental to the interests of ENJOYGM;
(5) you have violated any act, regulation, law, bylaw, rule, ordinance, guideline and/or policy of any authority, regulator or governmental body;
(6) you have acted in bad faith or maliciously, or we have reasonable grounds to believe that your behavior is harmful to other users, third parties and/or ENJOYGM. is harmful, defamatory or abusive;
(7) your name is included in any regulatory watch list (including but not limited to the list related to terrorism and terrorism financing under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLATFPUAA) and/or the list related to bribery and corruption under the Hong Kong Anti-Corruption Commission Act 2009 (MACCA) and/or other local, foreign or international laws and regulations of a similar nature);
(8) if we are required to do so by order of a court or any government or regulatory body with relevant jurisdiction;
(9) you have submitted false documents or declared false information during your registration or application with ENJOYGM; and/or
(10) you have failed to provide any other information we may request from you from time to time for verification purposes.
(11) If the Platform, Services and/or Account are used for suspicious, fraudulent, illegal, harassing, defamatory, threatening or abusive purposes, we may refer them to the relevant law enforcement agencies without prior notice.
4. Upon cancellation or termination of the Service (or any part thereof):
(12) Where feasible, unused ENJOYGM Points will be refunded to you. If ENJOYGM determines that a refund is not feasible, you will be entitled to use your ENJOYGM Points for a specific period of time as advised by ENJOYGM, subject to the Terms of Use herein and any such terms and conditions as ENJOYGM may determine;
(13) you will promptly pay all unpaid fees and charges due to ENJOYGM, failing which ENJOYGM will have the right, in its sole discretion, to commence a civil action against you, including, but not limited to, claims for damages, specific performance and/or interim or injunctive relief;
(14) ENJOYGM may, in its sole discretion, not act on any request received by ENJOYGM after the effective date of termination;
(15) ENJOYGM may, in its sole discretion, not act on any confirmation or request received by ENJOYGM between the date of ENJOYGM's notice to you and the effective date of termination (if there is a time interval between those dates); and/or
(16) you hereby irrevocably and unconditionally authorize ENJOYGM to deduct all amounts due from you to ENJOYGM (if any).
In addition to the foregoing, if your access to and/or use of the Platform and/or Services is suspended, stopped, or terminated due to suspicious, fraudulent, illegal, or unlawful transactions (including, but not limited to, violations of any laws (including, but not limited to, the Financial Services Act 2013, AMLATPUAA, and/or MACCA, or any rules, regulations, policies, and/or guidelines made thereunder), you will no longer be able to use your ENJOYGM Points and will not be entitled to any money or refund. ENJOYGM is lawful to indefinitely retain, process, or issue any money or refund (including your ENJOYGM Points) to relevant authorities at its sole discretion, subject to applicable laws, rules, regulations, and/or guidelines. You will not be entitled to any form of compensation for any losses incurred as a result.
Any express or implied provision in these Terms of Use that survives account deactivation and/or termination of the Services and is binding on you shall survive such termination.
15. Notices
1. All notices, demands, requests or other communications given or made under these Terms of Use shall be in writing and shall be sufficiently given or made to the other party by delivering such notice to the other party personally, by registered mail or by post. By email to the contact details notified by one party to the other party from time to time or through the communication channels available on the Platform.
2. Notices shall be deemed given:
(1) if delivered personally, upon receipt of written confirmation signed by the recipient;
(2) if sent by registered mail, five (5) business days after posting; and
(3) if sent by email or through the communication channels available on the Platform, on the day of transmission, provided that the sender does not receive a failure or undeliverable message from the recipient's hosting provider on the day of transmission.
3. Notwithstanding the foregoing, any notice, document or communication sent by ENJOYGM to you shall be deemed delivered by any of the following means, except for the above methods of delivery:
(4) posting of notices or communications on the Platform;
(5) notices published in any media; or
(6) any other means of notification determined by ENJOYGM in its sole discretion.
16. Waiver and Severance
1. ENJOYGM's failure at any time or for any period to enforce any one or more of these Terms of Use will not constitute a waiver of such provision or its right to enforce these Terms of Use at any subsequent time.
2. If any provision of these Terms of Use is declared invalid, voidable, illegal, or unenforceable by any judicial or other competent authority, ENJOYGM will modify such provision in a manner reasonably necessary to effect ENJOYGM's intent or, in its sole discretion, ENJOYGM may sever such provision from these Terms of Use, and the remaining provisions will remain in full force and effect.
17. Changes
1. ENJOYGM may modify, add to, delete, or alter these Terms of Use by posting on the Platform or by any other means as determined by ENJOYGM in its sole discretion.
2. You agree that your continued use of the Services constitutes your acceptance of these Terms of Use, as amended and modified from time to time.
18. Assignments
You may not assign your rights under these Terms of Use without ENJOYGM's prior written consent.
19. Binding Effect
These Terms of Use shall be binding upon your heirs, personal and legal representatives, estates, successors in title, and permitted assigns (as applicable).
